Terms of Service

Effective [DATE PLACEHOLDER]. Please read carefully.

This is a starting template. Have a lawyer review before launch.

BagX is a US-only, mobile-first peer-to-peer marketplace for buying and selling cornhole bags (ACL, ACO, and TCL). Sellers ship directly to buyers, and every seller is identity-verified through Stripe Connect before they can receive payment. The platform runs on Sharetribe infrastructure with payments processed by Stripe.

1. Acceptance

By creating an account, browsing, listing, buying, or selling on BagX, you agree to these Terms of Service.

If you do not agree, please do not use BagX. These terms apply every time you use the site or app.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use BagX.

You agree to provide accurate, current information when you sign up and to keep it up to date. Misleading or false information can result in account suspension.

3. Account responsibility

You are responsible for keeping your login credentials secure. Do not share your password.

Any activity that happens under your account is your responsibility. Tell us right away if you think your account has been accessed without your permission.

4. Listings (seller responsibilities)

When you list a bag, you confirm that you own it, you have the right to sell it, and your description is accurate, including league (ACL, ACO, or TCL), condition, model, and any wear.

Every listing must include the 4 mandatory photos described in the Selling FAQ: front and back of all 4 bags laid out together, plus a close-up front and back of one bag. You represent that all uploaded photos accurately reflect the current condition of the bag being sold. Misleading photos, stock images in place of the actual bag, or photos that do not match the item shipped are grounds for listing removal and possible account action.

As a seller, you ship directly to the buyer using the address provided at checkout. You agree to ship within the timeframe shown in your sale confirmation. Late or no-show shipments may be canceled and your account may be flagged.

5. Purchases (buyer responsibilities)

Buyers pay in full at checkout. Payments are processed through Stripe, which provides fraud detection and chargeback protection.

Provide an accurate shipping address and review the listing details before confirming your order. If something goes wrong with a transaction, see Section 8 for how to raise a dispute.

6. Seller verification

All sellers on BagX complete identity verification through Stripe Connect before they can receive payment. This includes legal name, US address, SSN, bank account verification, and government ID where required.

Sellers who fail or do not complete verification cannot receive funds. This is how we keep the marketplace trustworthy for buyers.

7. Fees & payouts

BagX charges a 9% platform fee on each sale, deducted from the seller's payout. Stripe processing fees also apply and are disclosed at checkout.

Seller payouts are released through Stripe after the buyer confirms delivery of the bag. Standard Stripe payout timing applies once funds are released.

8. Returns & disputes

If a bag does not arrive or is materially different from the listing, contact BagX support to open a dispute. Our team will review the order, communications, and evidence from both sides to help reach a resolution.

Buyers also retain the right to use Stripe's chargeback and dispute process through their payment method. "Change of mind" returns are not supported once a bag has shipped.

9. Prohibited conduct

Do not list counterfeit bags, fake league stamps, or items you do not have the right to sell. Do not harass, threaten, or abuse other users or our staff.

Do not try to move transactions off BagX to avoid fees or skip seller verification. Off-platform circumvention is grounds for account termination.

10. Intellectual property

Brand names, logos, and league marks (including ACL, ACO, and TCL) belong to their respective owners. BagX is not affiliated with or endorsed by those organizations unless stated.

When you post photos, descriptions, or other content, you grant BagX a non-exclusive license to use that content to operate, promote, and improve the marketplace.

11. Limitation of liability

BagX provides the marketplace platform that connects buyers and sellers. We do not own, inspect, or warrant the bags listed for sale, and we make no guarantees about individual items.

To the fullest extent allowed by law, BagX's liability for any claim related to your use of the marketplace is limited to the fees you paid to BagX on the transaction in question.

12. Termination

We may suspend or terminate any account that violates these terms, harms other users, or puts the marketplace at risk.

You can also close your account at any time. Open transactions must complete before an account can be fully closed.

13. Governing law

These terms are governed by the laws of the State of Texas, USA, where BagX operates.

Any disputes will be handled in the state or federal courts located in Texas, unless otherwise required by law.

14. Changes to terms

We may update these terms from time to time as the marketplace grows. When we do, we'll update the effective date at the top of this page.

Continued use of BagX after changes are posted means you accept the updated terms.
